If a driver refuses to file a report, which may be the case if they are uninsured, consider taking down their license plate number and asking for witnesses whose contact information you can obtain to support your testimony. You can then notify the police.

Driving without insurance is a crime. Victims of an accident caused by an uninsured driver will be compensated by the compulsory insurance guarantee funds (FGAO).

However, the person responsible for the uninsured accident will not be compensated for their own injuries or material damage under any circumstances. In addition, they will have to reimburse the FGAO for all amounts paid to compensate the victims of the accident.

In the event of an accident, the damages can reach very significant amounts. The driver responsible for the accident will therefore have to pay a monthly payment calculated based on their income, sometimes for the rest of their life.
